These Terms of Service ("Terms") govern your access to and use of ProdExam ("Service"), a usability testing platform operated by Montague Labs LLC, a Delaware-registered company ("Company," "we," "us," or "our"). By accessing or using the Service you agree to be bound by these Terms. If you do not agree, you may not use the Service.
You must be at least 13 years old to use ProdExam. Users under 18 must have parental or guardian consent. By creating an account, you represent that you meet these requirements and have the authority to enter into these Terms.
To access most features of the Service you must create an account. You agree to:
Account sharing is prohibited. Each user must have their own individual account. Team plans provide shared organizational access with individual seats for each team member.

Specific features and usage limits for each plan are described on our pricing page and may change over time.
Paid subscriptions are billed on a recurring basis (monthly or annually, depending on your selected plan). By subscribing, you authorize us to charge your payment method for the applicable fees. Payment processing is handled by Stripe; we do not store full credit card numbers on our servers.
We may change subscription fees at any time with at least thirty (30) days' prior notice. Price changes take effect at the start of your next billing cycle.
Strictly no refunds will be offered unless required by applicable law or at our sole discretion. Cancellations take effect at the end of your current billing period and you will not be charged for subsequent periods. No proration is provided for partial periods.

You retain ownership of any content you submit through ProdExam, including tests you create, questions you write, responses you collect, and any comments, screenshots, or other data your testers provide ("User Content"). By submitting User Content, you grant us a limited, worldwide, non-exclusive, royalty-free license to host, store, process, and display that content solely as necessary to operate and provide the Service to you.
You are responsible for ensuring you have the rights and consent necessary to collect, process, and upload any User Content, including responses from test participants and any personal data contained in them.
ProdExam, including the Service, the website, the SDK, our trademarks, logos, and all original content, features, and functionality, are and will remain the exclusive property of Montague Labs LLC and its licensors, and are protected by copyright, trademark, and other intellectual property laws.
Content uploaded by users may be subject to third-party copyrights. You represent that you have all necessary rights to any content you upload or process through the Service.
The Service integrates with third-party services, including Stripe for payments, Supabase for authentication and storage, OpenAI for AI analysis, and Resend for transactional email. Your use of those services is subject to their respective terms and privacy policies. We are not responsible for the practices of third-party services.
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. We do not warrant that the Service will be uninterrupted, secure, or error-free, or that defects will be corrected.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, MONTAGUE LABS LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, USE, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICE. Our total aggregate liability shall not exceed the greater of the amount you paid us in the twelve (12) months preceding the claim, or one hundred U.S. dollars (USD $100).
We may suspend or terminate your account at any time, with or without notice, for violations of these Terms, suspected fraud or abuse, legal requests, security issues, prolonged inactivity, or any reason at our sole discretion. You may cancel your account at any time through your account settings.
Upon termination, your right to use the Service ends. Sections that by their nature should survive termination will survive, including intellectual property, disclaimers, limitation of liability, and governing law.
We may update these Terms from time to time. When we make material changes, we will post the updated Terms on this page and update the effective date. Your continued use of the Service after the update constitutes acceptance of the revised Terms.
These Terms are governed by the laws of the State of Delaware, United States, without regard to its conflict-of-law provisions. Any dispute arising out of or relating to these Terms or the Service shall be brought exclusively in the state or federal courts located in Delaware, and you consent to their jurisdiction.
